Terms of Service
These Terms of Service ("Terms") are a binding agreement between todaysteck LLC ("QEQuiz," "we," "us") and the individual or entity that accesses or uses the QEQuiz platform ("you"). By accessing the Service, generating a test link, or taking an assessment, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
QEQuiz provides a web-based technical-assessment platform that lets Customers send candidates proctored, anti-cheat-protected assessments and review the results. We may modify or discontinue features at any time.
2. Accounts & eligibility
- You must be at least 18 years old and able to form a binding contract.
- Customer administrators are responsible for safeguarding their credentials and for all activity under their account.
- You agree to provide accurate information and to keep it current.
3. Customer responsibilities (employment use)
- You are solely responsible for your hiring decisions and for using assessment results lawfully.
- You represent that you have a lawful basis and any required notices/consents to invite each candidate and to process their data, including biometric data where applicable.
- You are responsible for compliance with employment, anti-discrimination, disability-accommodation, and biometric/privacy laws in your jurisdictions, including validating selection procedures and providing reasonable accommodations.
- QEQuiz provides a tool only and does not make, and is not responsible for, employment decisions.
4. Acceptable use
You agree not to: (a) reverse engineer, scrape, or copy the question bank or platform; (b) resell or sublicense the Service without authorization; (c) interfere with security or integrity features; (d) use the Service unlawfully or to infringe others' rights; or (e) upload malware or attempt unauthorized access.
5. Candidate conduct
Candidates agree to complete assessments honestly, without prohibited aids, and acknowledge the integrity monitoring described at the start of the assessment and in our Privacy Policy.
6. Fees
Paid features are billed as described at purchase (e.g., per-assessment pricing). Fees are non-refundable except as required by law or expressly stated. Taxes are your responsibility.
7. Intellectual property
The Service, including the question bank, software, and content, is owned by todaysteck LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. You retain rights to data you submit, and grant us a license to process it to provide the Service.
8. Privacy
Our Privacy Policy describes how we handle personal information and is incorporated into these Terms.
9. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that anti-cheat or proctoring features will detect all misconduct. Assessment results are one input and should not be the sole basis for any decision.
10. Limitation of liability
To the maximum extent permitted by law, todaysteck LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to the service will not exceed the greater of the amounts you paid us in the twelve (12) months before the claim or USD 100.
11. Indemnification
You will indemnify and hold harmless todaysteck LLC from claims arising out of your use of the Service, your hiring decisions, your content, or your violation of these Terms or applicable law.
12. Governing law & dispute resolution
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions below.
Binding arbitration. Except as stated below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules (or Consumer Arbitration Rules where applicable). The arbitration will be seated in Ohio, and judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. All claims must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.
30-day opt-out. You may opt out of this arbitration agreement by sending written notice within 30 days of first accepting these Terms; if you opt out, the dispute provisions below apply instead.
Exceptions. Either party may (a) bring an individual claim in small-claims court, and (b) seek injunctive or equitable relief in the state or federal courts located in Ohio to protect its intellectual property or confidential information. For any matter not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Ohio.
13. Changes
We may update these Terms and will revise the "Last updated" date. Continued use after changes constitutes acceptance.
